These terms and conditions are effective from 1st June, 2020
Definitions
TakeMyBookings.com is a website / web plugin system operated by Ngage Software Pty Ltd a company registered in New South Wales, Australia. The solution allows “Users” to insert code into their existing website to take bookings for products and/or services they provide to the “Clients of Users”.
Users are individuals, organisations or businesses that have an active “TakeMyBookings” account to engage existing and new clients to book their products and/or services.
Administrator - is the representative of the User who is responsible for the Users account management.
Client/s of Users - any type of person or entity that books an appointment or buys a product online with a User that has a User account with the TakeMyBookings.com system.
User Account — When a person or company signs up with the TakeMyBookings.com system, they get a user account with the TakeMyBookings.com system. This account can be used to register products/services, list User information, availabilities and ultimately take a booking and/or payment.
Plug-in – Application available for use within a User’s website.
If you use the TakeMyBookings.com system you agree to that you will not:
- violate any laws, third party rights or our policies;
- fail to deliver products and/or services unless the purchaser (Client/s of User) gets a refund or can get similar or same service at a different time and date agreed by both parties;
- post false, inaccurate, misleading, defamatory, libellous content (including personal information)
- distribute or post spam, unsolicited, or bulk electronic communications
- distribute viruses or any other technologies that may harm any visitors of the site;
- harvest or otherwise collect information from Client/s of Users, including email addresses, credit cards without their consent.
Acceptable Use
TakeMyBookings.com is a solution for service performers, and others that need to accept bookings for appointments, sell related services and products and make promotions to get more bookings. As such the TakeMyBookings.com service is ONLY intended for such usage and other unrelated usage is forbidden.
TakeMyBookings.com system should NOT be used for:
- Sending spam
- Unsolicited email or SMS
Users should treat all Client/s of User data with respect and appropriate privacy.
We reserve the right to cancel unconfirmed accounts or accounts that have been inactive for more than 8 weeks with no login from the Administrator and do not have a valid paid subscription. We reserve rights to modify or discontinue user accounts, that are affecting our system with unusual load, or usage that does not comply with our policy.
We reserve the rights to limit, suspend, or terminate our service and user accounts if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with our Terms and Conditions of use.
We reserve the rights in the case of high volume of bookings to suspend the relevant system momentarily to try to equalize the server load.
We take no responsibility on the functioning of our booking widgets when inserted on external sites or in other external solutions. We cannot control if it will work or if it will stop working even if it was working before.
Client/s of Users Purchase Protection
TakeMyBookings.com does not offer any purchase guarantees concerning Client/s Users payments for appointment bookings or service purchases or other product purchases from Users. TakeMyBookings.com offers Users a way to sell their services and Client/s Users book and/or purchase these services. TakeMyBookings.com takes no responsibility for wrongful service orders, services provided by Users or services not provided by Users even if they are purchased and paid for.
Fees
TakeMyBookings.com offers a free 30-day trial of system, we offer a number of packages available on our Pricing page. Users will be informed of fees before upgrading services.
When the 30-day free trial is completed the User will no longer be able to use the service unless they have selected and paid the appropriate fee.
Content and Data
When you upload and register content into the TakeMyBookings.com system, including information about you and your staff you confirm that you have full rights and permission to do so.
Account, Password and Security
The Administrator is responsible for maintaining the confidentiality of the password and access to your account. The User and their representative the Administrator are responsible for all activities that occur under your password or account and for compliance with regulatory, legal, and statutory requirements relevant to your jurisdiction.
TakeMyBookings.com cannot and will not be liable for any loss or damage arising from your failure to comply with this policy.
Limitation of Liability
TakeMyBookings.com is not responsible for yours or other Users' content, actions, or inactions. You acknowledge that our “Plug-in” is merely a vehicle to facilitate a booking and/or payment in a transaction between a seller (User) and a buyer (Client’s of User/s)
We cannot guarantee continuous or secure access to the Users website, as our own input is the code to facilitate the booking transaction. We neither host nor secure the User’s website.
User’s Terms & Conditions and Privacy policy
A User is responsible to list on their website their own terms and conditions and privacy policy for their clients (Client/s of User)
By providing a contact phone number for the Administrator of the User account the User provides us with your consent and authorisation to contact you through email, phone call or SMS messages (text messages) for any matter pertaining to this service.

If User’s have a support query they can log their request on our Support page or email [email protected]

Indemnity
You will indemnify and hold us (and our officers, directors and employees) harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
If you as a User have a dispute with one or more of your clients (Client/s of User) you release us (and our officers, directors and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
Changes
This policy may be changed from time to time. Changes take effect when we post them on the TakeMyBookings.com site.
